Celebrating 20 years of the Telecommunications Act

     The Telecommunications Act of 1996 transformed the communications industry from a group of isolated monopolies to a highly competitive, diverse and innovative marketplace. The Act accelerated massive investment and innovation in communications and information technology, propelling widespread adoption of powerful and connected technologies, which in turn led to unforeseen economic prosperity and consumer choice. New challenges are arising around privacy, intellectual property, cybersecurity and completing the deployment of broadband to all parts of the US. While the Telecom Act was ahead of its time in the 1990s, 20 years later it is time for a refresh given much of the Act is now obsolete. Learn more. [Source: USTelecom dailyLead, 02/08/2016]

Gearing Up for the GigaHome

     Now that cable operators, telcos and fiber providers are increasingly bringing gigabit speeds to broadband subscribers, can the GigaHome be all that far behind? Telecoms including AT&T and Verizon Communications are working to bring gigabit capacity to residential networks with the help of emerging standards, such as MoCA 2.0, that support higher bandwidth over coaxial cable. Experts say the proliferation of Internet-connected devices in the home will help drive the push, as Wi-Fi access becomes less reliable for supporting multiple users without interruption. FCC Releases 2016 Telecommunications Reporting Worksheets and Instructions

     The Wireline Competition Bureau issued a Public Notice on February 8, 2016, announcing release of the 2016 FCC Forms 499-A (annual Telecommunications Reporting Worksheet) to be used in 2016 to report 2015 revenues, and 499-Q (quarterly Telecommunications Reporting Worksheet) to be used in 2016 to report projected and collected revenues on a quarterly basis, and accompanying instructions for both. New Lifeline Rules Effective February 17

     The FCC published a Notice in the Federal Register on February 17, 2016, announcing that on January 5, 2016, the Office of Management and Budget approved the modified information collection requirements for certain rules adopted in the June 2015 Lifeline Reform Order. These rules include: strengthening the document retention requirements, ensuring that only ETCs directly serving low-income customers receive reimbursement under the Lifeline program, and requiring ETCs to use a uniform snapshot date to request reimbursement for the provision of Lifeline support. Chairman Wheeler Circulating RoR USF Reform Order for Approval

     Chairman Wheeler posted a blog on February 19, 2016, entitled Bipartisan Solutions for Universal Service, in which he indicated he circulated an Order last week to modernize USF support for rate-of-return carriers. He said the proposed Order sets forth a package of reforms, including: modernizing the program to provide support for stand-alone broadband service; improving incentives for broadband investment to connect unserved rural Americans; and strengthening the rate-of-return system to provide certainty and stability. He said the proposed Order would create a voluntary path to model-based support for RoR carriers that prefer the predictability of defined support amounts over a ten-year term. For carriers who choose to continue receiving support based on traditional RoR principles, the proposed Order would provide more certainty for carriers, increase fiscally responsible management of the Fund, and ensure that a reasonable portion of support is spent on new buildout to connect those that remain unserved. House Members Seek Answers on FCC Reporting of Broadband Deployment

     House Energy and Commerce Committee Chairman Fred Upton (R-Mich.) and Communications and Technology Subcommittee Chairman Greg Walden (R-Ore.) sent a letter to Chairman Wheeler on February 5, 2016, to express concern with the FCC's reporting on broadband deployment, video competition, and mobile wireless competition. They asserted that since 2011, the Commission has applied inconsistent definitions and analyses in making determinations about competition, and said the reports have then been used to justify Commission actions to intervene in seemingly competitive markets. They requested the FCC respond to their questions on the FCC's decision making and the FCC's shifting definitions of broadband by February 19, 2016. House Committee Approves Legislation Exempting Small Providers From Open Internet Transparency Requirements

     The House Committee on Energy and Commerce approved a bill, HR 4596 The Small Business Broadband Deployment Act, which would extend the exemption for small Internet service providers from the transparency requirements adopted in the FCC's Open Internet Order. They also approved an amendment to the bill, which proposes to sunset the exemption after five years. NTCA issued a statement in support of the legislation. [Source: Washington Watch, 02/26/2016]
