FCC to Create 5G Fund, Replacing Mobility Fund II

     Chairman Pai announced on December 4, 2019, he intends to establish the 5G Fund, which would make up to $9 billion in USF support available to carriers to deploy advanced 5G mobile wireless services in rural America. This new fund would replace the planned Mobility Fund Phase II, which would have provided federal support for 4G LTE service in unserved areas. Pai said this investment would be allocated through a reverse auction and would target hard-to-serve areas with sparse populations and/or rugged terrain. Pai said this new fund would set aside at least $1 billion specifically for deployments facilitating precision agriculture needs. The FCC also issued a report on December 4, 2019, in which Commission staff found the 4G LTE coverage data submitted by providers is not sufficiently reliable for the purpose of moving forward with MF II. The report recommended the FCC terminate the challenge process, audit the coverage filings of carriers in other proceedings before the FCC, and take additional steps to make sure coverage data is accurate. FCC Announces 2020 Reasonable Comparability Benchmarks for Fixed Voice, Broadband

     The Wireline Competition Bureau and the Office of Economics and Analytics issued a public notice on December 5, 2019, announcing the 2020 reasonable comparability benchmarks for fixed voice and broadband services for ETCs subject to broadband public interest obligations, including rate-of-return carriers, incumbent price cap carriers receiving CAF Phase II support, RBE providers and CAF Phase II auction winners. The bureau and OEA also announced the posting of the fixed voice and broadband services data collected in the most recent urban rate survey, and explanatory notes regarding the data, on the Commission’s website, as well as the required minimum usage allowance for ETCs subject to public interest obligations for fixed broadband. The 2020 rates are as follows: local voice service is $34.81; reasonable comparability benchmark for voice services is $54.76; and reasonable comparability benchmarks for broadband range from $73.81 for 4/1 Mbps (250 GB usage allowance) to $158.82 for 1000/100 Mbps (unlimited usage). The benchmarks for Alaska Plan carriers are higher. ETCs providing fixed voice and broadband services must certify they meet the benchmarks in the FCC Form 481 filed no later than July 1, 2020. USAC Files Federal USF Support Mechanisms Contribution Base for First Quarter 2020

     USAC filed the Federal Universal Service Support Mechanisms Quarterly Contribution Base for first quarter 2020 on December 2, 2019. The total projected collected interstate and international end-user revenue base to be used in determining the contribution factor for the USF support mechanisms for first quarter 2020 is $11,129,976,956, up from $11,017,439,561 in the previous quarter. FCC Officially Proposes 988 for National Suicide Hotline

     The Federal Communications Commission unanimously agreed to propose assigning 988 as the national hotline number for suicide prevention and other mental health crises saying the easily remembered number could encourage people to get the help they need. Congress had asked the FCC to study whether such a three-digit number was feasible. Read more [Source: USTelecom dailyLead, 12/12/2019]

Lifeline Reform Order Effective January 27

     The November 2019 report and order that made reforms to the Lifeline program was published in the Federal Register on December 27, 2019. Reforms included: prohibiting participating carriers from paying commissions to employees or sales agents based on the number of consumers who apply for or are enrolled in the Lifeline program with that carrier; and restoring the role of states in designating carriers to participate in the Lifeline program, among other things. The order is effective January 27, 2020, except for section 54.406(b), which is effective February 25, 2020, and section 54.406(a), which is effective March 26, 2020. Sections 54.404(b)(12) and 54.410(f) are delayed and the FCC will publish a document announcing the effective date. [Source: NECA Washington Watch, 12/27/2019]

Pai Responds to Congress on USF Budget Cap

     Chairman Pai sent letters to 14 members of Congress on December 2, 2019, in response to their letter expressing concern with the proposed USF budget cap, and urged the FCC not to establish an overall cap or combine the cap of any USF programs. Pai asserted each of the USF programs is currently capped or operating under a targeted budget, and an overall cap could help limit the overall contributions burden and provide regulatory and financial certainty to both recipients of and contributors to these programs. NTCA Discusses Rural Digital Opportunity Fund

     NTCA met with Commissioner Jessica Rosenworcel’s chief of staff on December 11, 2019, to discuss the rural digital opportunity fund. NTCA asserted the current weighting proposals for the RDOF will fall short of achieving reasonable comparability, and suggested the FCC promote the deployment of the most capable services possible in the initial rounds of the RDOF auction, and then turn to a remote areas program to address those areas still remaining unserved thereafter. NTCA discussed its RDOF weighting proposals, urged the FCC to recognize the benefits conferred by services providing symmetrical upload and download speeds through the adoption of a 15 point symmetrical bonus, and discussed the need for more forward-looking usage limitations than those proposed. NTCA also discussed steps the FCC should take to ensure greater accountability in the use of RDOF distributions. [Source: NECA Washington Watch, 12/13/2019]
