Billions in fiber investment needed to support next-generation broadband

     There's no other way around it. Significant investment in deep fiber deployment is necessary to support new 5G wireless and wireline broadband service offerings. In a recent study, Deloitte estimates that fiber investments of $130 billion to $150 billion over the next five to seven years will be necessary to support broadband competition, rural coverage, and wireless densification. NECA Urges Commission to Reaffirm RLEC Option to Offer Broadband Transmission on Title II Basis

     NECA filed comments on July 17, 2017, on the NPRM proposing to return internet broadband access service to the classification of a Title I information service. NECA said regardless of whether the Commission chooses to reclassify broadband internet access services as a Title I service or maintain the existing Title II classification, the Commission should reaffirm in any order it adopts in this proceeding that rural rate-of-return LECs will continue to have the option to offer broadband transmission services as a Title II common carriage service, either on a tariffed or non-tariffed basis. RUS Announces Second Application Window for Rural Broadband Loans

     The Rural Utilities Service issued a Notice in the Federal Register on July 26, 2017, announcing the second application window for fiscal year 2017 for the Rural Broadband Access Loan and Loan Guarantee, and the revised minimum and maximum amounts for broadband loans. The RUS said it has $115.2 million available in FY 2017 appropriated and carryover funds, and of this amount the agency expects that at least $60 million is available to fund applications received in this window. Applications under this Notice Of Funds Availability will be accepted immediately through September 30, 2017. [Source: Washington Watch, 07/26/2017]

FCC Eliminates Certain ETC Reporting Requirements

     The FCC issued a Report and Order on July 7, 2017, eliminating certain reporting requirements for ETCs that receive high-cost USF support that the FCC said are either duplicative of other reporting requirements or are no longer necessary. The FCC eliminated the requirement for: ETCs' annual reports to include detailed information about any outages affecting voice service for at least 30 minutes that they have experienced in the prior calendar year; ETCs to report the number of service requests they receive but do not fulfill; ETCs annually to report the number of complaints per 1,000 subscribers for voice and broadband services; ETCs to report annually information regarding the pricing of their voice and broadband service offerings; and ETCs to certify their compliance with applicable service quality standards and consumer protection rules. The FCC also eliminated, contingent upon USAC's completion of the rollout of an online portal for recipients of high cost services, the requirement that ETCs file duplicate copies of Form 481 with the FCC and with states, U.S. Territories and/or tribal governments beginning in 2018. Pai Directs USAC to Implement Safeguards for Lifeline Program

     Chairman Pai sent a letter to USAC on July 11, 2017, directing it to immediately implement safeguards to mitigate waste, fraud and abuse in the Lifeline program. Pai directed USAC to identify the top ten ETCs with the highest number of potentially ineligible subscribers according to GAO's study and audit them to determine whether they are properly verifying the eligibility of their subscribers. He also directed USAC to identify and review every address associated with 500 or more subscribers, and develop a process to identify ETCs with material discrepancies that cannot be adequately explained between the NLAD and claimed support on their Form 497 submissions. Pai also directed USAC to act on deceased subscribers, exact duplicates and sales agent accountability. He directed USAC to provide a report on implementation of these safeguards by August 8, 2017. NTCA Files Reply Comments Supporting Elimination of Local Service Rate Floor

     NTCA filed reply comments on July 24, 2017, on the NPRM that asks whether the Commission should change the current local service rate floor methodology or eliminate the rate floor and its accompanying reporting obligations. NTCA said the record in this proceeding supports elimination of the voice service rate floor. It said the one dissenting party based its opposition on the notion that eliminating the rate floor would benefit consumers nationwide, but NTCA argued this party misses what the NPRM and all other parties do not - HCLS funding reductions flowing from non-compliance with the rate floor do not accrue back to ratepayers, but is redistributed to other carriers by operation of the Commission's rules. NTCA said no additional burden would be placed on American ratepayers by virtue of eliminating the rate floor. Notice [Source: Washington Watch, 07/25/2017]

House Subcommittee Holds FCC Oversight, Reauthorization Hearing

     The House Subcommittee on Communications and Technology held an FCC Oversight and Reauthorization hearing on July 25, 2017, with Chairman Pai and Commissioners Clyburn and O'Rielly testifying. Pai discussed reauthorizing the agency and holding repacked broadcasters harmless after the incentive auction. He also said August will be Rural Broadband Month, noting at the August 3 Open Meeting the Commission will consider the next steps towards implementing the CAF and Mobility Fund reverse auctions, which together will allocate $6.5 billion for rural broadband expansion over the next decade. Clyburn discussed the open internet and implications of undoing Title II, Lifeline modernization, inmate calling reform, diversity and Connect2Health. O'Rielly discussed FCC reauthorization and processes improvements, pirate radio stations, broadcast incentive auction repack and infrastructure deployment, suggesting the Commission's high-cost program be used as a mechanism to distribute any new infrastructure funding.
