D.C. Circuit Issues Decision on Petitions for Review of Robocall Order

     The D.C. Circuit Court issued a Decision on March 16, 2018, granting in part and denying in part petitions for review of the 2015 Robocall Order in which the Commission sought to clarify various aspects of the TCPA's general bar against using automated dialing devices to make uninvited calls. The Court upheld the Commission's approach to revocation of consent, under which a party may revoke her consent through any reasonable means clearly expressing a desire to receive no further messages from the caller, and sustained the scope of the agency's exemption for time-sensitive health care calls. The Court, however, set aside the Commission's effort to clarify the types of calling equipment that fall within the TCPA's restrictions, and vacated the FCC's approach to calls made to a phone number previously assigned to a person who had given consent but since reassigned to another (nonconsenting) person. The Court ruled the FCC's one-call safe harbor, at least as defended in the Order, is arbitrary and capricious. Chairman Pai and Commissioners O'Rielly, Rosenworcel and Carr issued statements. FirstNet Review Board Will Decide How To Use Funds

     FirstNet board members have created the Investment Review Board to determine how $15 billion to be paid by contractor AT&T over a number of years will be spent. Second Quarter 2018 Proposed USF Contribution Factor is 18.4 Percent

     The FCC Managing Director issued a Public Notice on March 9, 2018, announcing the proposed universal service contribution factor for the second quarter of 2018 will be 18.4 percent, down from the current 19.5 percent. [Source: NECA Washington Watch, 03/12/2018]

Paper Details Survey on Urban, Rural Online Usage

     iGillottResearch released a white paper on March 7, 2018, entitled "A Cyber Economy: The Transactional Value of the Internet in Rural America." The paper, commissioned by the Foundation for Rural Service, detailed iGR's survey results on differences in internet usages between urban and rural Americans. The survey found, among other things: internet usage among urban and rural consumers was largely similar; rural consumers are responsible for more than 10.8 billion internet-driven transactions annually out of a total of 69.9 billion annual internet-driven transactions; and the estimated value of rural online transactions is nearly $1.4 trillion -14 percent of all internet-driven transactions, or seven percent of the U.S. nominal GDP. Broadband: The Anchor of 5G-powered Smart Cities

House Supports "dig once" Provision

     Mirroring what the State of Nevada and other states have already codeified the House of Representitives on Tuesday approved a "dig once" provision aimed at speeding fiber deployments and reducing costs by ensuring the installation of broadband pipes on many federally funded road projects. House Approves Broadband Funding in Spending Bill

     The U.S. House of Representatives passed a spending bill on March 21, 2018, that includes $600 million in federal funding for rural broadband initiatives. The bill passed by a vote of a 256-167.

     NTCA - The Rural Broadband Association applauded the bill's passage. "NTCA commends today's action by Congress to include $600 million in the omnibus for rural broadband deployment through a new pilot program to be administered by the U.S. Department of Agriculture's Rural Utilities Service (RUS)," said NTCA Chief Executive Officer Shirley Bloomfield.

     "We are excited by the promise of the resources provided within the omnibus and the prospect of continuing our members' work with RUS," Bloomfield said. "We are grateful to Congress for its attention to rural broadband concerns, and consistent with the directives of Congress, we hope that this new effort will build upon, and be coordinated with, existing broadband-focused initiatives within RUS and at the [FCC] to realize the shared goal of robust, affordable and sustainable universal broadband."

     Bloomfield said the association is looking forward to additional conversations with policymakers about how to "deliver on this vision." [Source: NTCA Washington Report, 03/22/2018]

Broadband groups look to help defend FCC's net neutrality rollback

     Broadband trade groups are showing their support for the Federal Communications Commission's decision to roll back net neutrality regulations, with USTelecom, NCTA-The Internet & Television Association and CTIA filing motions to intervene in the FCC's case to defend its rollback decision. Twelve lawsuits aiming at overturning the FCC's rollback have been consolidated into one and will be heard in the US Court of Appeals for the 9th Circuit. Read more... AT&T Enters Home Stretch With FirstNet Tests

     AT&T says it has completed work on the "brain and nervous system" of FirstNet under its exclusive contract with the emergency services network, with final testing to end in May, and local agencies can now connect to the core of the 4G network.
